A bit of humor at the beginning if you have decided to actually read a Privacy Statement. This IS NOT part of our privacy policy, but it is part of another competitor's statements:

"Except for cookies that may be sent to your computer by XXXXXXX Service third-party advertisers, and except for automatically-collected information as above provided to third-party tracking technologies, XXXXXXX will not disclose your information to other organizations unless required by law . . . "

Did that just say what I think it says? OMG, it does! They just disclosed they can collect anything while claiming to protect your privacy!

Pathagoras' privacy statement is intended to assure you that we keep your information PRIVATE! Be careful out there.

PRIVACY STATEMENT

               Innovative Software Products of Virginia, LLC, (ISPV) and the creator of Pathagoras™, recognize that you expect privacy and security for the non-public personal information we collect from you. We fully understand the need to safeguard sensitive information about you and we maintain standards and procedures designed to prevent misuse of this information.

General:

We collect, retain, and use information about you only to help us administer our products and services, your entitlement to the same, and to prevent abuse or fraud.

We do not provide non-public personal information to other companies including independent telemarketing or direct mail marketing companies.

We gather information about you to properly identify you, to validate your identity, and to verify any entitlements to upgrades, and entitlement to purchase additional licenses at discounted prices.

Our web site contains links to other sites, in particular PayPal.com and affiliates of PayPay (e.g., BrainTree), for the processing of orders using those third parties. Our subscription page (to sign up for 90 trial links to GetResponse.com, a newsletter mailing service which maintains information that you provided about your name, phone number (if provided at the time you signed up) and email address. Pathagoras is not responsible for the privacy practices or the content of those Web sites, but we have  have studied and are satisfied that the first tier of links provided by those services (process the credit card transactions and to properly maintain subscription and download information) properly protect the privacy of those who link thereto.

The United States federal government, some individual states, the European Union, and in the future, other countries, have (or will) set online privacy standards and have identified certain principles and guidelines to help ensure the protection of a consumer's non-public personal information. We intend to abide by those standards, and to that end provide the following notices.

Notice: It is our policy to treat all information you provide to us as confidential. We do not and will not disclose information to third parties about your account or the transactions you make, except in the most obvious of situations, which means ONLY in the following situations:

·        It is necessary to disclose your non-public personal information to the companies which will process credit card transactions that you have authorized for the initial purchase of Pathagoras (whether Pathagoras ‘on earth’ or Pathagoras On Cloud, and whether an outright purchase or a subscription), and for the renewal of any Support Agreements where you have specidfically authorized us to maintain such information in order to renew those services on a monthly basis. (In this regard, we only provide a ‘flow through service.’ We do not gather or maintain any of your credit card information at our site, but rather link you by secure connection to those third parties. Those third parties collect the necessary credit card information directly from you, and do not provide that information back to us. Upon confirmation of the purchase or subscription, or renewal, only your name, date of purchase or renewal and your email address are forwarded to us. We use only thoroughly vetted and well known third party processors (currently PayPal and BrainTree -- a PayPal affiliate. All third party processors maintain high standards of confidentiality, and maintain high levels of security in effecting the transaction in order to ensure the protection of your non-public personal information.

·        Similarly, when you sign up for a 90 day free trial of the program, we gather and transmit to the company we use to maintain our mailing and contact lists the information your provide, which is only your name, your email address, date of sign-up, and to the extent you provided it, your phone number. Certain geographic identification (the general area, state or country) is also transmitted, and confirmation is sent to us about your trial or subscription to one of our newsletters. Your name and email is used to mail you periodic notices on tips and techniques on using the program in your intial few weeks after you install it, and for mailing of periodic general newsletters announcing progam updates and upgrades.

·        We may disclose your non-public personal information to other sources ONLY if you give us your specific recorded-in-writing permission. We anticipate NEVER asking for that permission or disclosing the information.

We simply do not, and will not sell information about our customers to any third party. You will never receive mailings(e-mail or otherwise) about products from third party vendors which derive from any transaction you make on this site.

Access We have procedures that limit access to personally identifiable, non-public personal information only to principals of Innovative Software Products of Virginia, LLC,  

Security We practice regular safety precautions in maintaining customer lists and in preventing them from unauthorized disclosure and to prevent unauthorized access to, or unauthorized disclosure of, confidential information about you. Given the limited amount of information gathered from you and preserved on local medium (your name, e-mail address and phone number) maintained in a passcoded database of customers and stored on non-remotely accessible disk drives of the company's computers) we maintain no extraordinary security procedures. If you purchase by credit card, we are satisfied that the third party handlers of the credit transaction (currently BrainTree™and PayPal™ ) have implemented appropriate security standard and procedures to prevent unauthorized access to confidential informationabout you.  If you are subscribed to one of your newsletters either directly or from signing up for a free 90-trial of our product, or for the delivery of an free WhitePapers or other articles you may have read, we have also contracted with GetResponse to handle the collection of your data. We are satisfied that GetResponse has implemented appropriate security standard and procedures to prevent unauthorized access to your confidential information.

Your California Privacy Rights

California’s “Shine the Light” law permits customers in California to request certain details about how certain types of their information are shared with third parties and, in some cases, affiliates, for those third parties’ and affiliates’ own direct marketing purposes. Under the law, a business should either provide California customers certain information upon request or permit California customers to opt in to, or opt out of, this type of sharing. We reiterate that no data collected from you is ever shared with third parties except as indicated above (for handling purchases, determining entitlements to upgrades and additional licenses at a discount, notifying you of the expiration of any Support Agreements you may have purchases, notifying you of the expiration of any subscription service you may have purchased, and for publishing our periodic newsletters and notices of the availability of upgrades).

Your European Privacy Rights

If you are a data subject in the European Economic Area (“EEA”), you have additional right as provided under the General Data Protection Regulation (GDPR). Under those regulations, you have the right to access, rectify, or erase any personal data we have collected about you. You also have the right to data portability and the right to restrict or object to our processing of personal data we have collected about you. You may withdraw your consent at any time for any data processing we do based on consent you have provided to us.

These rights are in addition to all of the other statements we have made with regard to security and protection of your data at stated in other sections of this Privacy Statement.

To exercise any of these rights, contact us as set forth in the section entitled “Contact Us” below and specify which right you intend to exercise. We will respond to your request within 30 days. We may require additional information from you to allow us to confirm your identity. Please note that we store information as necessary to fulfill the purposes for which it was collected, and may continue to retain and use the information even after a data subject request for purposes of our legitimate interests, including as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

If you have any issues with our compliance, you have the right to lodge a complaint with an EEA supervisory authority.

Children

Our Service is a general audience service, and not directed to children under thirteen (13) years of age. ISPV does not knowingly collect personal information as defined by the U.S. Children’s Privacy Protection Act (“COPPA”) in a manner that is different from what is stated above, or not permitted by COPPA. If you are a parent or guardian and believe ISPV has collected such information in a manner not permitted by COPPA, please send an e-mail to us at info@pathagoras.com or a letter to us at ISPV, LLC, Legal Department, 117 Chisman Landing, Seaford, VA  23696, and we will remove such data to the extent required by COPPA.

    You have chosen to do business with us, and werecognize our obligation to keep the non-public personal information youprovide to us secure and confidential. We do not sell information aboutour customers to any third party.
